the teach act should be viewed as an opportunity to expand the online learning environment for teachers and students. however, only accredited, non-profit educational institutions with a valid teach act exemption may offer distance or online education. the benefits of online education for students and teachers have been previously discussed. also, teach courses must either have a course description or curriculum available on line that highlights the goals, content, and skills necessary to be successful. many institutions, however, lack the staff and resources to track and collect the necessary resources, much less publish them on line.

in order to successfully offer online education, accredited educational institutions must comply with the teach act's copyright laws. the teach act sets limitations for fair use, unauthorized distribution, and unauthorized copying. educators can be charged with copyright infringement by posting or distributing non-educational materials online.


sometimes teachers are confused by the terms authorized and authorized use. the authorized use of a copyrighted work refers to when a school or institution is given permission to use a copyrighted work pursuant to the teach act. the authorized use refers to the specific activity permitted by the teach act. for example, a school may have permission to use copyrighted work for test review, but the act limits the use of the copyrighted material to only one or two times.


under the teach act, the following activities are permitted, at a public or private school or non-profit educational institution: (1) teaching, and for teaching, the displaying of a nonexempt work that is owned by the institution in which the performance is taking place, (2) displaying a nonexempt work for instructional purposes where it is owned by an institution in which the performance is taking place, and (3) displaying, performing or playing an educational video or audio cd owned by the institution in which the performance is taking place, or using other authorized media to present educational video or audio works of that institution.
